I begin by criticizing an elaboration of an argument in this journal due to Hawley , who argued that, where Leibniz’s Principle of the Identity of Indiscernibles faces counterexamples, invoking relations to save PII fails. I argue that insufficient attention has been paid to a particular distinction. I proceed by demonstrating that in most putative counterexamples to PII , the so-called Discerning Defence trumps the Summing Defence of PII. The general kind of objects that do the discerning in all cases (...) form a category that has received little if any attention in metaphysics. This category of objects lies between indiscernibles and individuals and is called relationals: objects that can be discerned by means of relations only and not by properties. Remarkably, relationals turn out to populate the universe. (shrink)

What is colour vision for? In the popular imagination colour vision is for “seeing the colours” — adding hue to the achromatic world of shape, depth and motion. On this view colour vision plays little more than an ornamental role, lending glamour to an otherwise monochrome world. This idea has guided much theorising about colour within vision science and philosophy. However, we argue that a broader approach is needed. Recent research in the psychology of colour demonstrates that colour vision is (...) integral to a variety of visual processes, helping us to perform many types of visual tasks. We discuss some of this research and consider its implications for philosophical theories of colour. (shrink)

The aim of this paper is to try to clarify the nature and justification of respect for the law. In section I, I try to clarify the nature of respect for a legal system and distinguish it from related concepts. In the next section, I consider problems justifying the attitude of respect toward a legal system. In section III, I discuss the extent to which one has duties to behave respectfully toward and to try to adopt an attitude of respect (...) toward a reasonably just legal system. One consequence is that it is difficult to show that one has a duty to obey the law because it is respect-worthy. In the last section, I sketch further consequences of preceding sections and suggest that respect for the law properly understood is neither the boon of oppression nor the bane of conscientious moral agents. We demonstrate that the quantum-mechanical description of composite physical systems of an arbitrary number of similar fermions in all their admissible states, mixed or pure, for all finite-dimensional Hilbert spaces, is not in conflict with Leibniz's Principle of the Identity of Indiscernibles (PII). We discern the fermions by means of physically meaningful, permutation-invariant categorical relations, i.e. relations independent of the quantum-mechanical probabilities. If, indeed, probabilistic relations are permitted as well, we argue that similar bosons can also be discerned in all (...) their admissible states; but their categorical discernibility turns out to be a state-dependent matter. In all demonstrated cases of discernibility, the fermions and the bosons are discerned (i) with only minimal assumptions on the interpretation of quantum mechanics; (ii) without appealing to metaphysical notions, such as Scotusian haecceitas, Lockean substrata, Postian transcendental individuality or Adamsian primitive thisness; and (iii) without revising the general framework of classical elementary predicate logic and standard set theory, thus without revising standard mathematics. This confutes: (a) the currently dominant view that, provided (i) and (ii), the quantum-mechanical description of such composite physical systems always conflicts with PII; and (b) that if PII can be saved at all, the only way to do it is by adopting one or other of the thick metaphysical notions mentioned above. Among the most general and influential arguments for the currently dominant view are those due to Schrodinger, Margenau, Cortes, Dalla Chiara, Di Francia, Redhead, French, Teller, Butterfield, Giuntini, Mittelstaedt, Castellani, Krause and Huggett. We review them succinctly and critically as well as related arguments by van Fraassen and Massimi. (shrink)

The defining principle of evolutionary biology is that all species, extant and extinct, evolved from ancient prokaryotic cells. Their initial appearance and adaptive evolution are proposed to have been accompanied by a cellular sentience, by feelings, subjectivity or, in a word, 'consciousness'. Prokaryotic cells, such as archaea and bacteria, have natural unitary, valence-marked 'mental' representations. They process and evaluate sensory information in a context-dependent manner. They learn, establish memories, and communicate using biophysical fields acting on excitable membranes. Symbiotic eukaryotic cells, (...) which evolved much later, initiated a compound cellular subjectivity utilizing 'senomic' and 'ephaptic' principles that evolved into the varieties of consciousness seen in multicellular species. This Cellular Basis of Consciousness (CBC) model provides a novel framework within which to approach fundamental issues such as the origins of life and the emergence of mind. (shrink)

The use of biotechnology in food productiongives rise to consumer concerns. The term ``consumerconcern'' is often used as a container notion. Itincludes concerns about food safety, environmental andanimal welfare consequences of food productionsystems, and intrinsic moral objections againstgenetic modification. In order to create clarity adistinction between three different kinds of consumerconcern is proposed. Consumer concerns can be seen assigns of loss of trust. Maintaining consumer trustasks for governmental action. Towards consumerconcerns, governments seem to have limitedpossibilities for public policy. Under current (...) WTOregulations designed to prevent trade disputes,governments can only limit their policies to 1) safetyregulation based upon sound scientific evidence and 2)the stimulation of a system of product labeling. Ananalysis of trust, however, can show that ifgovernments limit their efforts in this way, they willnot do enough to avoid the types of consumer concernsthat diminish trust. The establishment of a technicalbody for food safety – although perhaps necessary –is in itself not enough, because concerns that relatedirectly to food safety cannot be solved by ``pure''science alone. And labeling can only be a good way totake consumer concerns seriously if these concerns arerelated to consumer autonomy. For consumer concernsthat are linked to ideas about a good society,labeling can only provide a solution if it is seen asan addition to political action rather than as itssubstitution. Labeling can help consumers take uptheir political responsibility. As citizens, consumershave certain reasonable concerns that can justifiableinfluence the market. In a free-market society, theyare, as buyers, co-creators of the market, andsocietal steering is partly done by the market.Therefore, they need the information to co-create thatmarket. The basis of labeling in these cases, however,is not the good life of the individual but thepolitical responsibility people have in their role asparticipants in a free-market. Then, public concernsare taken seriously. Labeling in that case does nottake away the possibilities of reaching politicalgoals, but it adds a possibility. (shrink)

The notorious ‘measurement problem’ has been roving around quantum mechanics for nearly a century since its inception, and has given rise to a variety of ‘interpretations’ of quantum mechanics, which are meant to evade it. We argue that no less than six problems need to be distinguished, and that several of them classify as different types of problems. One of them is what traditionally is called ‘the measurement problem’. Another of them has nothing to do with measurements but is a (...) profound metaphysical problem. We also analyse critically Maudlin’s (Topoi 14:7–15, 1995) well-known statement of ‘three measurements problems’, and the clash of the views of Brown (Found Phys 16:857–870, 1986) and Stein (Maximal of an impossibility theorem concerning quantum measurement. Finally, we summarise a solution to one measurement problem which has been largely ignored but tacitly if not explicitly acknowledged. (shrink)

Introduction: This study, the first of its kind in Iran, was to assess Iranian patients’ preferences for receiving information and participating in decision-making and to evaluate their satisfaction with how medical information is given to them and with their participation in decision-making at present. Method and materials: 299 of 312 eligible patients admitted to general internal medicine or surgery wards from May to December 2006 were interviewed according to a structured questionnaire. The questionnaire contained questions about patients’ preferences regarding four (...) domains of information and their participation in decision-making. Patients’ responses were measured on a visual analogue scale graded from 1 to 10. Results: The mean (SD) score for desire to receive information was 8.88 out of 10 (1.5) and for participation in medical decision-making was 7.75 out of 10 (3). The desire to receive information was greater in women than men (9.0 (1.5) vs 7.8 (1.4), p = 0.025). It was also correlated with their education (r = 0.2, p = 0.001) and their estimation of the severity of their own disease (r = 0.13, p = 0.027). The score for preference to participate in decision-making was higher in women than in men (7.95 (2.8) and 7.0 (3.2), respectively; β = 0.8, p = 0.022) and was negatively correlated with education (r = −0.14, p = 0.015). Discussion: This study shows that Iranian patients are highly interested in receiving information about their condition and participating in clinical decision-making. No predictive variable for such attitudes was found; therefore, the only way for the physician to recognise patients’ desire is to ask them explicitly. (shrink)

Augustine’s metaphysics is a subject little studied, but often much criticized. Among the recent studies of Augustine’s metaphysics, Scott MacDonald’s interpretation of Augustine’s notion of goodness claims that Augustine’s account is incoherent. This suggests a reading of Augustine that is somewhat problematic. This article argues that much of the difficulty that MacDonald claims rests on a misunderstanding of Augustine’s views about the goodness of creation and existence and the corruptibility of created things. Augustine’s position takes for granted an understanding of (...) existence as a good and the participation of all things in the pre–eminent good, that is God. (shrink)

The use of human fetal tissue for scientific research has enormous potential but is subject to government legislation. In the United Kingdom the Polkinghorne Committee's guidelines were accepted by the Department of Health in 1990. These guidelines set out to protect women undergoing termination of pregnancy from exploitation but in so doing may significantly restrict potential research. Although the committee took evidence from a wide variety of experts they did not seek the views of the general public. We asked 108 (...) women about to have a therapeutic abortion; 167 women who had had a pregnancy terminated in the past, and 419 women who had never had an abortion, their views on research using human fetal tissue. Regardless of their past experiences the women were overwhelmingly in favour of research using fetal tissue (94 per cent). They made little distinction between basic research and research with obvious clinical relevance and supported the concept of using transplanted fetal tissue for the treatment of adult disease such as Parkinsonism. Women about to undergo an abortion were significantly more likely (p < 0.001) to approve of all types of research including that aimed at improving methods of abortion and research using live fetuses in utero. Nicholas Wolterstorff's Divine Discourse attempts to give philosophical warrant to the claim that ‘God speaks’. While Wolterstorff's argument depends largely on his appropriation of J.L. Austin's speech act theory, he also uses two narratives that for him demonstrate how ‘God speaks’. The first is the story of Augustine's conversion in the Confessions and the second is a story that Wolterstorff recounts about a certain ‘Virginia’. This study argues that what Wolterstorff claims to derive from Augustine's narrative for his view of (...) divine discourse is not fully supported by the Confessions, and that Augustine's interpretation of the words ‘tolle lege, tolle lege’, can be construed as a useful interpretation of an ambiguous sign. This is consistent with Augustine's understanding of the interpretation of texts in both the De doctrina christiana and the Confessions. In short, Augustine is far more open to the ambiguity of signs than Wolterstorffs's account suggests. (shrink)

Iris Murdoch’s Metaphysics as a Guide to Morals ranges wide over the field of Western philosophical thought. Throughout the work, Murdoch proposes and enacts a form of philosophical inquiry that she believes supports a moral philosophy based on the idea of the good. One of her attempts, partly inspired by Paul Tillich and J. N. Findlay, centers on her critique and appropriation of the structure of the so-called “ontological argument” in Anselm’s Proslogion. This study assesses Murdoch’s accomplishment and the tenability (...) of the kind of Platonism she proposes against Anselm’s argument about the good in both the Monologion and the Proslogion. My claim is that Anselm’s conception of the good simply does not permit the kind of interpretation that Murdoch puts on the “ontological argument.”. (shrink)

One of the reasons provided for the shift away from an ontology for physical reality of material objects & properties towards one of physical structures & relations (Ontological Structural Realism: OntSR) is that the quantum-mechanical description of composite physical systems of similar elementary particles entails they are indiscernible. As material objects, they 'whither away', and when they wither away, structures emerge in their stead. We inquire into the question whether recent results establishing the weak discernibility of elementary particles pose a (...) threat for this quantum-mechanical reason for OntSR, because precisely their newly discovered discernibility prevents them from 'whithering away'. We argue there is a straightforward manner to consider the recent results as a reason in favour of OntSR rather than against it. (shrink)

Researchers have identified the phenomena of moral distress through many studies in Western countries. This research reports the first study of moral distress in Iran. Because of the differences in cultural values and nursing education, nurses working in intensive care units may experience moral distress differently than reported in previous studies. This research used a qualitative method involving semistructured and in-depth interviews of a purposive sample of 31 (28 clinical nurses and 3 nurse educators) individuals to identify the types of (...) moral distress among clinical nurses and nurse educators working in 12 cities in Iran. A content analysis of the data produced four themes to describe the nurses’ moral distress. The four themes were as follows: (a) institutional barriers and constraints; (b) communication problems; (c) futile actions, malpractice, and medical/care errors; (d) inappropriate responsibilities, resources, and competencies. The results demonstrate that moral distress for intensive care unit nurses is different and that the nursing leaders must reduce moral distress among nursing in intensive care. (shrink)

We discuss the case against Factorism, which is the standard assumption in quantum mechanics that the labels of the $$\otimes$$ ⊗ -factor Hilbert-spaces in direct-product Hilbert-spaces of composite physical systems of similar particles refer to particles, either directly or descriptively. We distinguish different versions of Factorism and argue for their truth or falsehood. In particular, by introducing the concepts of snapshot Hilbert-space and Schrödinger-movie, we demonstrate that there are Hilbert-spaces and $$\otimes$$ ⊗ -factorisations where the labels do refer, even descriptively, (...) to similar particles, which renders them probabilistically absolutely discernible.
